Terms and conditions of sold products on Serious Audio

Article 1 - Purpose

The present terms and conditions govern the sale by Serious Audio rue 75 Paris of .

Article 2 - Prices

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and exclusive of processing and shipping costs. In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. Serious Audio is not responsible for these fees and charges. They are your responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to check with your local authorities. All orders, whatever their origin, are payable in euros. Serious Audio reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability. Products remain the property of Serious Audio until full payment has been received. Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Article 3 - Ordering

You can place an order: On the Internet: en.serious.audio. Contractual information is presented in French and will be confirmed at the latest when your order is validated. Serious Audio reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 4 - Validation of your order

Any order placed on the serious.audio website implies acceptance of these General Terms and Conditions. Confirmation of an order implies full acceptance of these terms and conditions of sale, without exception or reservation. All data supplied and the recorded confirmation shall constitute proof of the transaction. You declare that you are fully aware of them. Confirmation of the order will constitute signature and acceptance of the operations carried out. A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the e-mail address used to confirm your order.

Article 5 - Payment

The validation of your order implies the obligation to pay the indicated price. Payment for your purchases is made by credit card through a secure system. The card will only be charged at the time of order shipment. In the case of partial deliveries, only the shipped products will be charged.

Article 6 - Withdrawal

In accordance with Article L.121-21 of the french Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without justification or penalty. Returns must be made in their original and complete condition (packaging, accessories, instructions). You are responsible for any damage to the product, which may negate the right of withdrawal. Return costs are free. In the event of withdrawal, Serious Audio will refund the amounts paid within 14 days following the notification of your request, using the same payment method as used during the order.

Exceptions to the right of withdrawal:

Services fully performed before the end of the withdrawal period, with the express prior agreement of the consumer.
Goods or services whose price depends on fluctuations in the financial market beyond the control of the professional.
Goods made to the consumer's specifications or clearly personalized.
Goods likely to deteriorate or expire rapidly.
Goods unsealed by the consumer after delivery, which cannot be returned for reasons of hygiene or health protection.
Goods mixed inseparably with other items after delivery.
Alcoholic beverages delivered after more than thirty days, the value of which depends on market fluctuations.
Audio/video recordings or computer software unsealed by the consumer after delivery.
Supply of a newspaper, periodical, or magazine, except for subscriptions.
Transactions concluded at a public auction.
Digital content not supplied on a tangible medium, if the execution begins after the express prior agreement and waiver of the consumer's right of withdrawal.

Article 7 - Availability

Our products are offered as long as they are visible on the serious.audio website and within the limits of available stocks. For non-stocked products, our offers are valid subject to availability from our suppliers. In case of product unavailability after placing your order, you will be notified by email. Your order will be automatically canceled, and no bank debit will be made. Additionally, the serious.audio website is not intended to sell its products in large quantities. Therefore, Serious Audio reserves the right to refuse orders for identical items.

Article 8 - Delivery

Products are delivered to the delivery address provided during the ordering process, within the specified timeframe indicated on the order validation page. In the event of a shipping delay, an email will be sent to inform you of any potential impact on the stated delivery time. According to legal provisions, if there is a delivery delay, you have the option to cancel the order under the conditions and procedures defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will proceed with its refund and shipping costs in accordance with Article L 138-3 of the Consumer Code. In the case of deliveries by a carrier, Serious Audio cannot be held responsible for delivery delays solely due to the unavailability of the customer after several appointment proposals.

Article 9 - Warranty

All our products benefit from the legal warranty of conformity and hidden defects as provided by Articles 1641 and following of the Civil Code. In the event of non-compliance with a product sold, it can be returned, exchanged, or refunded. All claims, requests for exchange, or refund must be made by email within 30 days of delivery. The products must be returned to us in the condition in which you received them with all elements (accessories, packaging, instructions, etc.). The shipping costs will be refunded based on the invoiced rate, and the return costs will be reimbursed upon presentation of receipts. The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 - Liability

The offered products comply with the current French legislation. Serious Audio cannot be held liable for non-compliance with the laws of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibilities of importing or using the products or services you intend to order. Furthermore, Serious Audio cannot be held responsible for damages resulting from the improper use of the purchased product. Finally, the liability of Serious Audio cannot be engaged for any inconveniences or damages inherent to the use of the Internet, including a service interruption, external intrusion, or the presence of computer viruses.

Article 11 - Applicable law in case of dispute

The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

Article 12 - Intellectual property

All elements of the en.serious.audio website are and remain the exclusive intellectual property of Serious Audio. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any simple link or hypertext link is strictly forbidden without the express written consent of Serious Audio.

Article 13 - Personal data

Serious Audio reserves the right to collect nominative information and personal data concerning you. This information is required to process your order and to improve the services and information we send you. It may also be transmitted to companies that contribute to this relationship, such as those responsible for the management, execution, processing and payment of services and orders. This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.

Article 14 - Archiving Proof

Serious Audio will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code. Serious Audio's computerized records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
